The Foundation of Civilization

Letter to the Item editor:

            The Foundation of Civilization

Regarding the front page story in the Item where a ninety year old male
was entrapped in a police sting operation for the "crime" of seeking
some female companionship. I have a suggestion for the victim of that
assault and fraud. Exercise your right to a trial by jury. Base your
defense on the fact that voluntary, peaceful relationships between
human beings are the foundation of civilization.

Prove to the jury, beyond all reasonable doubt, that honest trade is not
a crime, no matter what any government says. In a free society, no one
has the right to stand between a willing buyer and a willing seller.
Human beings providing each other with goods and services in a
peaceful manner is the keystone of morality and wealth production.

Explain to the jury their right to nullify bad laws. Although judges
rarely inform juries of their nullification power, every member of a
jury has the legal authority to vote "Not Guilty" if he believes that
the defendant is being prosecuted for violating an unjust law or that
law has been misapplied. Justice is above all man-made laws. The
purpose of the law is to serve justice.

If the accused lacks the confidence or knowledge to take on such a task,
I will volunteer to present his case to the jury. I will explain to the jury

that justice is the mother of law, not the daughter. It only takes one
juror to throw a wrench into the gears of injustice. Even if every juror
is an authoritarian or sheep, the victim can be proud of the fact
that he did the right thing and did not go down without a fight.
